SPECIAL COUNCIL PROCEEDINGS

MAY 24, 2004

 

 

A special meeting of the Menominee City Council, City of Menominee, County of Menominee, State of Michigan, was held Monday, May 24, 2004 at 5 p.m. in the Municipal Complex Council Chambers.

The Honorable George W. Krah called the meeting to order and led the pledge of allegiance to the flag.

PRESENT: Council Members Fernstrum, Hudon, Jasper, Mick, Organ, Plemel, Schloegel, and Sorensen

PRESENT: 9 ABSENT: 0

 

Mayor Krah opened the special meeting that he called for the purpose of considering the following agenda:

    1. Pledge of allegiance to the flag.

    1. Public comment on agenda items only.
    2. Resolution #4 for the special assessment district on 14th Street, 15th Street, and 42nd Avenue.
    3. The Public Safety Committee on the appointment of a firefighter.
    4. Approval of the plat for Circle Lane III.
    5. Motion on an economic development program.
    6. Public comment.
    7. Adjourn to closed session to discuss pending litigation (Krygoski Construction Company, Inc. v City of Menominee, United States District Court, Western District of Michigan, Case No.: 04-CV-076).
    8. Adjourn.

A motion was made by Council Member Organ and seconded by Council Member Sorensen to approve the agenda with nine agenda items for the meeting dated May 21, 2004. This motion was carried unanimously.

 

PUBLIC COMMENT:

Mayor Krah opened the public comment session that was called for the purpose of hearing citizen comments on agenda items only.

No one was heard.

A motion was made by Council Member Jasper and seconded by Council Member Mick to close the public comment session. This motion was carried unanimously.

The following resolution was next on the agenda:

RESOLUTION NO. 4

CITY OF MENOMINEE,

COUNTY OF MENOMINEE, MICHIGAN

SPECIAL ASSESSMENT DISTRICT FOR

14th STREET (40th AVENUE TO 42nd AVENUE)

15th STREET (41st AVENUE TO 42nd AVENUE)

42nd AVENUE (13th STREET TO 15th STREET)

STREET CONSTRUCTION PROJECT

WHEREAS, a public hearing was held on the proposed special assessment district for curb and gutter construction on 14th Street (40th Avenue to 42nd Avenue), 15th Street (41st Avenue to 42nd Avenue), and 42nd Avenue (13th Street to 15th Street); and

WHEREAS, Council has met and reviewed the special assessment roll and considered objections, if any, regarding same;

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Menominee hereby confirms said special assessment roll and determines the number of installments of said roll and the rate of interest to be in accordance with P-98-2 Special Assessment Payment Policy.

Council Member Jasper asked that he be excused from voting because he owns property in the district.

A motion was made by Council Member Mick and seconded by Council Member Organ to excuse Council Member Jasper from voting. This motion was carried unanimously with an abstention by Council Member Jasper.

A motion was made by Council Member Plemel and seconded by Council Member Fernstrum to adopt the foregoing resolution.

AYES: Hudon, Krah, Mick, Organ, Plemel, Schloegel, Sorensen, and Fernstrum

NAYS: None

This motion was carried unanimously with an abstention by Council Member Jasper.

 

COMMITTEE REPORT:

The Public Safety Committee reported that they had held interviews for the position of Fire Fighter and recommended that Christopher Dessart be appointed to this position under the customary probationary period conditional upon satisfactory completion of psychological and physical examinations.

A motion was made by Council Member Sorensen and seconded by Council Member Hudon to adopt the foregoing report. This motion was carried unanimously.

A motion was made by Council Member Fernstrum and seconded by Council Member Plemel to approve the final plat for Circle Lane Subdivision III. This motion was carried unanimously.

 

A motion was made by Council Member Organ and seconded by Council Member Sorensen to accept the concept of joint economic development and continue to explore. This motion was carried unanimously.

 

PUBLIC COMMENT:

Mayor Krah opened the public comment session.

No one was heard.

A motion was made by Council Member Jasper and seconded by Council Member Sorensen to close the public comment session. This motion was carried unanimously.

 

ADJOURN TO CLOSED SESSION TO DISCUSS PENDING LITIGATION:

A motion was made by Council Member Plemel and seconded by Council Member Organ to adjourn to closed session to discuss pending litigation (Krygoski Construction Company, Inc. v City of Menominee, United States District Court, Western District of Michigan, Case No.: 04-CV-076).

AYES: Jasper, Krah, Mick, Organ, Plemel, Schloegel, Sorensen, Fernstrum, and Hudon

NAYS: None

This motion was carried unanimously.

 

A motion was made by Council Member Plemel and seconded by Council Member Jasper to return to open session. This motion was carried unanimously.

 

Mayor Krah invited everyone to participate in placing flags on the graves at Riverside Cemetery on Wednesday afternoon (May 26th) at 3 p.m.

 

ADJOURN:

A motion was made by Council Member Mick and seconded by Council Member Sorensen to adjourn the meeting. This motion was carried unanimously.
