REGULAR COUNCIL PROCEEDINGS
MARCH 21, 2005
A regular meeting of the Menominee City Council, City of Menominee, County of Menominee, State of Michigan, was held Monday, March 21, 2005 at 5 p.m. in the Municipal Complex Council Chambers.
A motion was made by Council Member Organ and seconded by Council Member Hudon that Council Member Plemel chair the meeting. This motion was carried unanimously.
Council Member Plemel called the meeting to order and led the pledge of allegiance to the flag.
PRESENT: Council Members Fernstrum, Hudon, Jasper, Organ, Plemel, Schloegel, and Sorensen;
ABSENT: Mayor Krah and Council Member Mick (both excused)
PRESENT: 7 ABSENT: 2
A motion was made by Council Member Organ and seconded by Council Member Sorensen to excuse Mayor Krah and Council Member Mick from the meeting. This motion was carried unanimously.
A motion was made by Council Member Fernstrum and seconded by Council Member Jasper to approve the agenda for the meeting dated March 15, 2005. This motion was carried unanimously.
There being no additions or corrections to the minutes of the regular meeting of February 21, 2005, the minutes stood approved as presented.
PUBLIC HEARING:
Council Member Plemel opened the public comment period that was called for the purpose of hearing citizen comments on the proposed grant application to the Michigan Department of Environmental Quality Coastal Management Program for the Downtown Lakefront Walkway Lighting project.
No one was heard.
A motion was made by Council Member Fernstrum and seconded by Council Member Jasper to close the public hearing. This motion was carried unanimously.
PUBLIC COMMENT:
Council Member Plemel opened the public comment session that was called for the purpose of hearing citizen comments on agenda items only.

COMMITTEE REPORT:
At a March 14, 2005 meeting the Buildings and Grounds Committee reviewed selling a small strip of adjacent property between 2515 18th Street and 2504 19th Street and they recommended that the property be sold to the adjoining property Walter Durow at a cost of $125, based upon the fact that the property was offered to the other two adjoining property owners and they declined the offer.

A motion was made by Council Member Jasper and seconded by Council Member Hudon to adopt the foregoing report.

This motion was carried unanimously.
COMMITTEE REPORT:
At a meeting held March 14, 2005 the Finance Committee reviewed the General Fund claims for the month of February 2005 in the amount of $344,310.94 and they recommended that checks be drawn on the treasurer in payment of the bills.

A motion was made by Council Member Fernstrum and seconded by Council Member Jasper to adopt the foregoing report. This motion was carried unanimously.
COMMITTEE REPORT:
At a March 14, 2005 meeting the Judicial and Legislative Committee reviewed the proposed Tree Ordinance and they recommended scheduling a public hearing and proceeding with adopting the ordinance.

A motion was made by Council Member Fernstrum and seconded by Council Member Hudon to adopt the foregoing report. This motion was carried unanimously.
COMMITTEE REPORT:
At a March 14, 2005 meeting the Parks and Recreation Committee reviewed the communication from City of Marinette Mayor Doug Oitzinger regarding the City of Menominee's interest in joining a partnership to construct and operate a multi-purpose facility and they recommended that the city manager respond informing him that the City's number one priority is the Spies Field project, but we're still interested in keeping an open dialogue with them as their project moves forward.

A motion was made by Council Member Fernstrum and seconded by Council Member Sorensen to adopt the foregoing report. This motion was carried unanimously.
COMMITTEE REPORT:
At a March 14, 2005 meeting the Parks and Recreation Committee reviewed submitting a grant application to the Michigan Department of Environmental Quality Coastal Management Grant Program for the Menominee Downtown Lakefront Walkway Lighting Project and they recommended that the following resolution be adopted and the city manager be authorized to submit this application:
RESOLUTION
WHEREAS, the City of Menominee by and through its elected representative body wishes to submit a project for inclusion under the Michigan Department of Environmental Quality Coastal Management Grant Program, namely the Menominee Downtown Lakefront Walkway Lighting Project; and
WHEREAS, the City desires to secure financial assistance from the Michigan Department of Environmental Quality Coastal Management Grant Program to help defray the costs of the project; and
WHEREAS, the City understands that matching funds will be made available from its Downtown Development Authority; and
WHEREAS, City Manager Anthony D. Furton will be the designated authorized project representative;
NOW, THEREFORE, BE IT RESOLVED, that the City of Menominee City Council authorizes the filing of an application with the Michigan Department of Environmental Quality Coastal Management Grant Program and to provide the local share of matching funds, and that the Menominee Downtown Lakefront Walkway Lighting Project will be undertaken if the grant is awarded.

A motion was made by Council Member Jasper and seconded by Council Member Fernstrum to adopt the foregoing report. This motion was carried unanimously.
MOTIONS AND RESOLUTIONS:
The first item under motions and resolutions was the following resolution:
RESOLUTION ESTABLISHING
INDUSTRIAL DEVELOPMENT DISTRICT #10
FOR R. W. FERNSTRUM AND COMPANY, INC.
WHEREAS, pursuant to Act No. 198 of the Public Acts of 1974, as amended, this City Council has the authority to establish "Industrial Development Districts" within the City of Menominee; and
WHEREAS, R. W. Fernstrum and Company, Inc. has petitioned this City Council to establish an Industrial Development District on its property located in the City of Menominee hereinafter described; and

WHEREAS, construction, acquisitions, alterations, or installation of a proposed facility has not commenced at the time of filing the request to establish this district; and
WHEREAS, written notice has been given by mail to all owners of real property located within the district, and to the public by newspaper advertisement in the Eagle Herald and/or public posting of the hearing on the establishment of the proposed district; and
WHEREAS, on February 21, 2005 a public hearing was held at which all of the owners of real property within the proposed Industrial Development District and all residents and taxpayers of the City of Menominee were afforded an opportunity to be heard thereon; and
WHEREAS, the City Council deems it to be in the public interest of the City of Menominee to establish the Industrial Development District as proposed;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Menominee that the following described parcel of land situated in the City of Menominee, County of Menominee, and State of Michigan, to wit:
Lot "K" of W.G. Boswell's 2nd Addition to the City of Menominee,
Menominee County, Michigan
be and hereby is established as an Industrial Development District pursuant to the provision of Act No. 198 of the Public Acts of 1974 to be known as Industrial Development District #10.
Council Member Fernstrum asked that she be allowed to abstain from voting.
A motion was made by Council Member Organ and seconded by Council Member Hudon that Council Member Fernstrum be allowed to abstain from voting. This motion was carried unanimously.
A motion was made by Council Member Organ and seconded by Council Member Hudon to adopt the foregoing report. This motion was carried unanimously with an abstention by Council Member Fernstrum.
The following proclamation was considered next:
PROCLAMATION
April 2005
WHEREAS, Head Start has been a quality early childhood program operating locally since the mid 1960's; and
WHEREAS, Head Start provides comprehensive services in the areas of early childhood education, health and nutrition, and social-emotional development; and
WHEREAS, Head Start serves the entire family with emphasis on parental involvement; and
WHEREAS, Head Start also gives parents a chance to learn job skills, provides educational and tutoring services, and an opportunity to increase parenting skills; and

WHEREAS, local Head Start staffing is made up of more than 25% past or current parents of Head Start children; and
WHEREAS, Head Start has earned an outstanding reputation as a most successful program that not only responds to social challenges, but has proven effective in reducing future grade retention, delinquency, school dropout, unemployment and criminal activity; and
WHEREAS, Head Start is composed of young children, loving families, dedicated staff and volunteers, and outstanding community supporters; and
WHEREAS, the Head Start spirit, a very positive attitude where goals are identified and progress is recognized, has made an impact on families to the extent that the community is a better place, especially for our children;
NOW, THEREFORE, WE, the Menominee City Council do hereby proclaim April 2005 as "HEAD START MONTH" and urge all the citizens of the City of Menominee to support and reflect on the outstanding results of Head Start.
A motion was made by Council Member Organ and seconded by Council Member Jasper to adopt the foregoing proclamation. This motion was carried unanimously.

Council Member Plemel opened the public comment session.
A moment of silence was held for former Mayor Mary Kreuz who passed away.
A motion was made by Council Member Jasper and seconded by Council Member Organ to close the public comment session. This motion was carried unanimously.
ADJOURN TO CLOSED SESSION TO DISCUSS PENDING LITIGATION:
A motion was made by Council Member Fernstrum and seconded by Council Member Jasper to adjourn to closed session to discuss pending litigation (Krygoski Construction Company, Inc. v City of Menominee, United States District Court, Western District of Michigan, Case No.: 04-CV-076).

This motion was carried unanimously.
RETURN TO OPEN SESSION:
A motion was made by Council Member Fernstrum and seconded by Council Member Sorensen to return to open session. This motion was carried unanimously.
