REGULAR COUNCIL PROCEEDINGS
FEBRUARY 21, 2005
A regular meeting of the Menominee City Council, City of Menominee, County of Menominee, State of Michigan, was held Monday, February 21, 2005 at 5 p.m. in the Municipal Complex Council Chambers.
The Honorable George W. Krah called the meeting to order and led the pledge of allegiance to the flag.
PRESENT: Council Members Fernstrum, Hudon, Jasper, Organ, Plemel, Schloegel, and Sorensen;
Mayor Krah
ABSENT: Council Member Mick (excused)
PRESENT: 8 ABSENT: 1
A motion was made by Council Member Plemel and seconded by Council Member Organ to excuse Council Member Mick from the meeting. This motion was carried unanimously.
A motion was made by Council Member Plemel and seconded by Council Member Fernstrum to approve the agenda for the meeting dated February 18, 2005 with the deletion of the closed session to discuss pending litigation. This motion was carried unanimously.
There being no additions or corrections to the minutes of the regular meeting of January 17, 2005, the minutes stood approved as presented.
PUBLIC HEARING:
Mayor Krah opened the public hearing that was called for the purpose of hearing citizen comments on the proposed three year capital improvement program.
No one was heard.
A motion was made by Council Member Plemel and seconded by Council Member Jasper to close the public hearing. This motion was carried unanimously.
Mayor Krah opened the next public hearing that was called for the purpose of hearing citizen comments on the establishment of an industrial development district as requested by R.W. Fernstrum and Company, Inc.
Sean Fernstrum said they were considering purchasing new equipment ($500,000) and possibly adding a few jobs.

A motion was made by Council Member Plemel and seconded by Council Member Jasper to close the public comment session. This motion was carried unanimously.

Mayor Krah submitted for confirmation the appointment of Sheila MacIntyre to the Downtown Development Authority, replacing Susan Bunting who resigned, with her term to expire on January 25, 2009. This motion was carried unanimously.
COMMITTEE REPORT:
At a February 14, 2005 meeting the Buildings and Grounds Committee reviewed Application for Payment #7 and final in the amount of $25,526.68 to The Markell Company for Reroofing of the Municipal Complex and they recommended that it be approved.

At a meeting held February 14, 2005 the Finance Committee reviewed the General Fund claims for the month of January 2005 in the amount of $378,300.59 and they recommended that checks be drawn on the treasurer in payment of the bills.

COMMITTEE REPORT:
At a February 14, 2005 meeting the Finance Committee reviewed the Michigan Department of Natural Resources requirement that the City provide a letter of credit for the Spies Field wetlands mitigation project and they recommended accepting the offer from Nicolet National Bank to provide the letter at a cost of $500.

COMMITTEE REPORT:
At a February 14, 2005 meeting the Finance Committee reviewed the proposals received to finance the 2002 Lodal sanitation vehicle and they recommended that the low proposal be accepted from Farmers and Merchants Bank and Trust at an interest rate of 3.5% (three annual installments of $30,100.75).

COMMITTEE REPORT:
At a February 14, 2005 meeting the Finance Committee reviewed the proposed settlement of the City's claim for past due personal property taxes against K-Mart and they recommended that the City accept $27,206.14 (which is 70% is the actual assessment for the taxes for 2001 and 2002).

COMMITTEE REPORT:
At a meeting held February 14, 2005 the Parks and Recreation Committee reviewed the communication from the State of Michigan Department of History, Arts and Libraries regarding the transfer process of the Menominee North Pier light under the National Historic Lighthouse Preservation Act of 2000 and they recommended that the city officials be authorized to submit an official letter of interest after the Notice of Availability has been issued on March 1, 2005.

COMMITTEE REPORT:
At a February 14, 2005 meeting the Public Works Committee reviewed equipment needs in the Public Works Department and recommended purchasing a new model 2004 trackless snowblower attachment at the cost of $7,577 from Bruce Equipment and they further recommended that the bid process be waived due to its compatibility with the power unit with the funds allocated from the equipment reserve and accounted for in the 2005 budget process.
